Terms of Use

These terms set the conditions for using Hercules Residents Directory. Accessing or using the reference means you accept them. If you do not agree, do not use it.

1. About This Reference

Hercules Residents Directory is a privately operated reference to public rolls, record indexes, and directory collections connected with Hercules, Contra Costa County, and California. It describes routes to the City Clerk, county Assessor and Clerk-Recorder, Superior Court, vital-record custodians, libraries, and archives. It does not host government records and is not affiliated with any office, court, library, or records custodian.

2. Acceptable Use

Use the reference only in a lawful, respectful way. California's Safe at Home program, Government Code §§6205-6216, provides substitute-address and confidential-voter protections for eligible participants. Do not try to defeat those protections or use the pages, linked tools, or information found through them to:

  • Stalk, harass, intimidate, threaten, or harm another person
  • Locate a person protected by a restraining order, protective order, or Safe at Home confidentiality
  • Commit identity theft, fraud, or another unlawful act
  • Make an FCRA-regulated decision involving credit, employment, tenant screening, insurance, or another covered purpose
  • Scrape, copy, or republish the reference at scale
  • Interfere with its operation, availability, or security

3. No Consumer Reports

Hercules Residents Directory is not a consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. Neither the reference nor a result returned by a linked search tool is a consumer report. None may be used to decide eligibility for credit, employment, housing, insurance, tenant screening, or another purpose regulated by the FCRA.

4. External Services

Government portals and third-party services, including sponsored search tools, publish their own terms and privacy policies. Hercules Residents Directory does not control or guarantee their content, availability, pricing, security, or data practices.

5. No Warranties

The reference is supplied "as is" and "as available," without warranties of any kind. No promise is made that a detail is accurate, complete, or current, or that a linked portal will work or produce a correct result.

6. Liability Limits

To the fullest extent allowed by law, the operators are not liable for direct, indirect, incidental, consequential, or special damages arising from use of this reference or a linked resource, including a decision made from a record located through it.

7. Indemnification

You agree to indemnify and hold the operators harmless from a claim or demand, including reasonable attorneys' fees, that results from your misuse of the reference or breach of these terms.

8. Intellectual Property

The original writing, design, logo, and layout are protected by copyright. Linking to a page and quoting a brief attributed excerpt is welcome. Republishing full pages or systematically copying the content is not.

9. Changes to the Terms

A revised version may be posted here from time to time. Continued use after the revision is posted means that the updated terms are accepted.

10. Access Restrictions

Access may be blocked or restricted for a user who violates these terms or abuses the reference, at the operators' discretion and without advance notice.

11. California Law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Requests to Hercules or Contra Costa County agencies for identifiable existing public records are governed by the California Public Records Act, Government Code §§7920.000-7931.000; that law does not make this private reference the custodian. California privacy rights may also arise under the California Consumer Privacy Act and California Privacy Rights Act, Civil Code §1798.100 et seq., subject to their definitions, exceptions, and thresholds.

12. Severability

If a court finds one part of these terms unenforceable, the remaining provisions continue in effect.
